EU AI Act Article 4: AI Literacy Training Is Already Mandatory. Are Your Teams Trained?

On February 2, 2025, Article 4 of the EU AI Act (Regulation (EU) 2024/1689) became enforceable. This was not a recommendation. It was not a future deadline. It was the first binding obligation of the entire regulation, and it applied immediately to every company using AI systems in the European Union.

The requirement is simple: ensure that your staff and anyone operating AI systems on your behalf has a sufficient level of AI literacy.

Most companies missed it. Some have never heard of it. If you are reading this and wondering whether your organization has complied - the honest answer is probably not.

Here is what Article 4 actually requires, who it applies to, and what you need to do right now.

What Does Article 4 of the EU AI Act Say?

The full text of Article 4 is short. That is part of the problem - people underestimate it because it looks simple. Here is the core obligation:

"Providers and deployers of AI systems shall take measures to ensure, to the best extent possible, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used."

Three things stand out:

  1. "Providers and deployers" - this means both companies building AI and companies using AI. If your company uses ChatGPT, Copilot, automated HR screening, AI-based analytics, or any other AI system, you are a deployer.

  2. "To the best extent possible" - this is not a pass to do nothing. Regulators interpret this as a proportionality requirement. You must do what is reasonable given your size, resources, and the risk level of the AI you use.

  3. "Considering the persons or groups of persons on whom the AI systems are to be used" - your training must also account for the people affected by your AI decisions. If your AI system processes loan applications, your staff must understand how that impacts applicants.

Who Must Comply With Article 4?

Everyone.

This is not an exaggeration. Unlike the high-risk system requirements in Articles 6-49, which apply only to specific categories of AI, Article 4 applies universally. The scope includes:

Companies That Build AI Systems (Providers)

If you develop, train, or put AI systems on the EU market, your development teams, product managers, sales staff, and support teams all need AI literacy training relevant to their roles.

Companies That Use AI Systems (Deployers)

This is the category most organizations fall into and the one most are ignoring. If your company uses any AI system - including SaaS tools with AI features - you are a deployer under the AI Act.

Examples of deployers who must comply:

  • A law firm using AI for document review
  • A bank using automated credit scoring
  • A retailer using AI-powered inventory management
  • A marketing agency using AI content generation tools
  • An HR department using AI resume screening
  • A hospital using AI-assisted diagnostics
  • A logistics company using route optimization algorithms
  • Any company whose employees use ChatGPT or similar tools for work

Third Parties Operating AI on Your Behalf

Contractors, consultants, and outsourced teams who interact with your AI systems are also covered. You are responsible for ensuring they have adequate AI literacy, not just your direct employees.

The Geographic Scope

Article 4 follows the same territorial rules as the rest of the AI Act. It applies if:

  • Your company is established in the EU
  • Your AI system's output is used in the EU
  • You deploy AI systems that affect people in the EU

A US company using AI to process job applications from EU candidates must ensure its staff handling that system is AI-literate. There is no geographic escape clause.

What Does "AI Literacy" Actually Mean?

The AI Act defines AI literacy in Article 3(56):

"Skills, knowledge and understanding that allow providers, deployers and affected persons, taking into account their respective rights and obligations in the context of this Regulation, to make an informed deployment of AI systems, and to be aware of the opportunities and risks of AI and possible harm it can cause."

In practical terms, AI literacy means your people should understand:

Foundational Knowledge

  • What AI systems are and how they differ from traditional software
  • The basic principles behind machine learning, including how models are trained and how they make predictions
  • The difference between narrow AI (task-specific) and general-purpose AI
  • What large language models are and what they can and cannot do

Operational Understanding

  • How the specific AI systems they use work at a functional level
  • What data goes into the system and what decisions come out
  • The limitations of the AI systems they interact with
  • When to trust AI output and when to override it
  • How to identify when an AI system is producing errors, biases, or hallucinations

Regulatory Awareness

  • The existence and basic structure of the EU AI Act
  • Their role and responsibilities under the regulation
  • The risk classification of the AI systems they work with
  • Documentation and reporting obligations relevant to their position
  • The rights of individuals affected by AI decisions

Ethical and Risk Awareness

  • How AI systems can produce discriminatory outcomes
  • The concept of algorithmic bias and its real-world consequences
  • Privacy implications of AI data processing
  • The importance of human oversight in AI-assisted decisions
  • When and how to escalate concerns about AI system behavior

What Does Compliant AI Literacy Training Look Like?

Article 4 does not prescribe a specific training format, certification, or curriculum. This is intentional - the training must be proportionate to the context. But "proportionate" does not mean "optional." Here is what a defensible training program includes:

1. Role-Based Training Tiers

Not everyone needs the same depth of training. A practical approach splits training into three tiers:

Tier 1 - General awareness (all staff)

  • What AI is and how the company uses it
  • Basic rights and obligations under the AI Act
  • How to report concerns about AI behavior
  • Duration: 2-4 hours

Tier 2 - Operational users (staff who interact with AI systems daily)

  • How specific AI tools work and their limitations
  • Data handling procedures for AI systems
  • When to trust and when to question AI output
  • Bias detection and escalation procedures
  • Duration: 8-16 hours

Tier 3 - Technical and compliance staff (developers, data scientists, compliance officers)

  • Deep technical understanding of AI/ML systems
  • Risk assessment methodologies
  • Documentation requirements under the AI Act
  • Monitoring and audit procedures
  • Duration: 24-40 hours

2. Documentation of Training

You need records that prove you provided training. This includes:

  • Training materials and curriculum
  • Attendance records with dates
  • Assessment results (tests, quizzes, practical exercises)
  • Evidence of ongoing/refresher training
  • Records of which AI systems each trained person interacts with

3. Ongoing Updates

AI literacy is not a one-time checkbox. Your training program must evolve when:

  • New AI systems are deployed in the organization
  • Existing AI systems are updated or changed
  • New regulatory guidance is published
  • Incidents occur that reveal knowledge gaps
  • Staff roles change

4. Assessment and Verification

You need a way to verify that training was effective. This does not require formal certification, but some form of assessment is expected:

  • Post-training knowledge checks
  • Practical exercises with the AI systems employees use
  • Scenario-based assessments (e.g., "what would you do if the AI output seemed biased?")
  • Periodic re-assessment to ensure retention

The February 2, 2025 Deadline Has Passed. What Now?

If your organization has not implemented AI literacy training, you are already non-compliant. The question is what to do about it.

Step 1: Inventory Your AI Systems

You cannot train people on AI systems you do not know about. Start with a full inventory:

  • What AI systems does your organization use?
  • Who interacts with each system?
  • What decisions do these systems influence?
  • What data do they process?

This inventory also feeds into your broader EU AI Act compliance obligations.

Step 2: Assess Current AI Literacy Levels

Survey your staff to understand their baseline:

  • Do they know what AI systems they use daily?
  • Can they explain how these systems influence their work?
  • Are they aware of the AI Act and its requirements?
  • Do they know how to identify and report AI errors or biased outcomes?

Step 3: Design Role-Appropriate Training

Based on your inventory and assessment, build training that matches actual needs. Generic "Introduction to AI" courses are not sufficient. Your training must reference the specific AI systems your organization uses.

Step 4: Deliver and Document

Roll out training with proper documentation. Keep records of everything. If a national AI authority asks to see evidence of your AI literacy program, you need to produce it.

Step 5: Establish an Ongoing Program

Set up a schedule for refresher training and updates. Assign responsibility for maintaining the program. Connect it to your broader AI governance framework.

If this sounds like a lot of work, it is. But the alternative is facing enforcement action for a requirement that has been in effect for over a year.

Penalties for Non-Compliance

Article 4 falls under the general enforcement provisions of the AI Act. While the penalty structure is primarily designed around the higher-risk categories, failure to ensure AI literacy is still a violation of the regulation.

National authorities have the power to:

  • Issue warnings and orders to comply
  • Impose administrative fines
  • Require corrective measures within specified timeframes
  • Publish findings of non-compliance

The maximum fines under the AI Act are structured in tiers:

  • Up to 35 million EUR or 7% of global turnover for prohibited AI practices
  • Up to 15 million EUR or 3% of global turnover for violations of other obligations (including Article 4)
  • Up to 7.5 million EUR or 1.5% of global turnover for supplying incorrect information

For SMEs and startups, the lower of the two figures applies (the fixed amount or the percentage).

Will regulators immediately fine companies for missing AI literacy training? Probably not in the first enforcement wave. But when they investigate a company for any AI-related issue - a biased hiring algorithm, an AI system that caused harm, a data protection complaint - the first thing they will check is whether the organization had proper AI governance in place. AI literacy training is the most basic element of that governance.

Companies that cannot demonstrate they trained their staff will have a much harder time defending any other aspect of their AI compliance.

FAQ

Is AI literacy training mandatory for small companies?

Yes. Article 4 applies to all providers and deployers of AI systems regardless of company size. The proportionality principle means your training program should match your resources and the complexity of the AI systems you use. A 10-person company using ChatGPT for customer support needs less extensive training than a bank running automated credit scoring, but both must provide some level of AI literacy education.

What counts as an "AI system" under the AI Act?

The AI Act defines an AI system as "a machine-based system that is designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment and that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments" (Article 3(1)). In practice, this covers chatbots, recommendation engines, automated decision-making tools, predictive analytics, image recognition, and most modern SaaS tools that use machine learning features.

Can we use online courses to satisfy the AI literacy requirement?

Online courses can be part of your training program, but generic courses alone are unlikely to satisfy Article 4. The regulation requires that training considers "the context the AI systems are to be used in." This means at least part of your training must be specific to your organization's AI systems and use cases. A combination of general AI knowledge (which can be delivered online) and organization-specific practical training is the most defensible approach.

What happens if we trained some staff but not all?

Partial compliance is better than no compliance, but it does not satisfy Article 4. The obligation covers "staff and other persons dealing with the operation and use of AI systems." If someone in your organization interacts with an AI system and has not received appropriate training, you have a gap. Start with the highest-risk roles (those using AI for decisions that affect people) and work outward from there.
